Terms of Use / 利用規約

1. Acceptance of Terms

By installing, accessing, or using Daily Space Journey (the “Service”), you agree to be bound by these Terms of Use. These Terms constitute a binding agreement between you and miketako3 (“I,” “me,” or “my”). If you do not agree, do not use the Service. If you access the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

2. Eligibility & Accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. Certain features such as leaderboards, purchases, or cloud sync require an authenticated Apple ID or Game Center account. You are responsible for maintaining the confidentiality of your device and account credentials.

3. Personal License & Ownership

I grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes. All artwork, code, text, and audio remain my property or that of respective licensors. Except where explicitly permitted, you may not copy, distribute, rent, sell, reverse engineer, or otherwise exploit the Service.

4. User Responsibilities

• Provide accurate journey data and respect the “one acceleration per day per slot” rule.
• Do not submit unlawful, hateful, adult, violent, or misleading content. NG-word filters may automatically reject content.
• Share only content you have the right to distribute and respect the privacy of others.
• Do not attempt to hack, scrape, overload, or interfere with Firebase, Remote Config, or any related infrastructure.

5. Community & Rankings

Leaderboards display aggregated distance and velocity metrics per planetary segment. I may remove entries that appear fraudulent, abusive, or inactive for more than 90 days. Community logs are public by design, may be translated per app language, and can be indexed or shared by other users. You are solely responsible for any information you publish, and I disclaim all responsibility for how third parties use, remix, or redistribute public submissions.

6. Purchases, Ads & Experiments

The Service may surface Remote Config experiments, rewarded ads, banner ads, or one-time purchases. Viewing an ad may restore streak velocity but has no cash value. Payments are processed by Apple; please follow Apple’s refund procedures. Remote Config can enforce force-updates or A/B text variations without further notice.

7. Data & Privacy

Usage of the Service is also governed by the Privacy Policy. By using the Service you consent to the processing of Game Center profile data, analytics, crash reports, ad identifiers, and community submissions as described there.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available.” I disclaim all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. I do not guarantee uninterrupted availability, lack of bugs, or that your personal goals will be achieved.

9. Limitation of Liability

To the maximum extent permitted by law, I disclaim all liability for any claim, damage, or loss arising out of or relating to the Service. Under no circumstances will I be liable for direct, indirect, incidental, consequential, special, exemplary, punitive, or any other damages, including without limitation lost profits, loss of goodwill, data loss, personal injury, property damage, or business interruption, even if advised of the possibility of such damages. You waive and release any right to seek monetary or injunctive relief from me in connection with your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless miketako3 from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Suspension & Termination

I may suspend or terminate access to the Service (including removal of community content or leaderboard entries) at any time if you violate these Terms, compromise security, or create risk for other users. You may stop using the Service at any time; deleting the app does not automatically erase stored data, so please contact me for deletion requests.

12. Modifications

I may update these Terms to reflect product changes or legal requirements. When changes are material, I will provide notice via in-app messaging, Remote Config banner, or this site before they take effect unless urgent safety or legal needs require immediate application. Continued use after the effective date constitutes acceptance.

13. Governing Law

Unless prohibited by local law, these Terms are governed by the laws of Japan. Any dispute will be submitted to the exclusive jurisdiction of the Tokyo District Court.

1. 規約への同意

Daily Space Journey（以下「本サービス」）をインストールまたは利用することで、本規約に同意したものとみなします。本規約は利用者とmiketako3（以下「運営者」）との間で法的拘束力を持つ契約です。不同意の場合は本サービスを利用しないでください。組織を代表して利用する場合は、当該組織を拘束する権限を有することを表明します。

2. 利用条件とアカウント

本サービスを利用できるのは13歳以上（または各地域で定められた最低年齢以上）の方です。ランキングや購入、クラウド同期など一部機能にはApple IDまたはGame Centerでの認証が必要です。端末やアカウントの管理は利用者の責任で行ってください。

3. ライセンスと所有権

運営者は、本サービスを個人的かつ非営利目的で利用する限定的・取消可能・譲渡不可のライセンスを付与します。アート、コード、テキスト、音声などの権利は運営者または権利者に帰属します。明示的に許可された場合を除き、複製・配布・販売・逆コンパイル等は行わないでください。

4. 利用者の責任

• 旅の記録や目標を正確に入力し、各スロット1日1回の加速ルールを尊重してください。
• 違法・差別・アダルト・暴力的・虚偽の内容を投稿しないでください。NGワードフィルタにより自動的に拒否されることがあります。
• 権利を保有するコンテンツのみ共有し、他者のプライバシーを尊重してください。
• FirebaseやRemote Configなどの基盤を解析・妨害・過負荷にする行為を行わないでください。

5. コミュニティとランキング

ランキングでは各惑星区間の距離・速度が表示されます。90日以上活動がない場合や不正が疑われる場合、運営者はエントリを削除できます。タイムラインやギャラリーの投稿は公開情報であり、アプリの表示言語ごとに翻訳・引用されることがあります。投稿内容については利用者が全責任を負い、第三者による利用や転載について運営者は一切責任を負いません。

6. 購入・広告・実験

本サービスではRemote Configによる実験、リワード広告、バナー広告、単発課金を提供する場合があります。広告視聴で連続ボーナスを回復できる場合がありますが、金銭価値はありません。課金処理はAppleを通じて行われ、返金等はAppleの手続きに従ってください。Remote Configにより強制アップデートやA/Bテストが即時適用されることがあります。

7. データとプライバシー

本サービスの利用にはプライバシーポリシーが適用されます。Game Centerプロフィール、分析データ、クラッシュログ、広告ID、コミュニティ投稿等の取り扱いについて理解し同意ください。

8. 免責事項

本サービスは「現状有姿」かつ「提供可能な範囲」で提供されます。商品性、特定目的適合性、正確性、非侵害などの暗示的保証を含むいかなる保証も行いません。無停止稼働や目標達成を保証するものではありません。

9. 責任制限

法律で認められる最大限の範囲で、運営者は本サービスに起因または関連して生じた一切の損害・損失・請求について責任を負いません。直接損害・間接損害・付随的損害・結果的損害・特別損害・懲罰的損害などのいかなる損害についても責任を負わず、利用者は金銭的・差止めその他いかなる救済も運営者に求めないものとします。

10. 免責補償

利用者は、本サービスの使用、規約違反、第三者の権利侵害に起因して生じる請求・損害・費用（合理的な弁護士費用を含む）から運営者を免責し、防御し、補償することに同意します。

11. 利用停止・終了

利用者が規約に違反し、セキュリティを損ない、または他者にリスクを与えると判断した場合、運営者は通知なくアクセス停止・コンテンツ削除を行うことがあります。利用者はいつでも利用を停止できます。アプリ削除のみではデータは自動削除されないため、削除を希望する場合は運営者に連絡してください。

12. 規約の変更

機能追加や法令対応のため、本規約を改定する場合があります。重要な変更はアプリ内メッセージや本サイトで事前告知します（緊急の安全・法的要請を除く）。改定後も利用を継続した場合、変更に同意したものとみなします。

13. 準拠法・裁判管轄

法令で禁止されていない限り、本規約は日本法に準拠し、紛争は東京地方裁判所を第一審の専属的合意管轄裁判所とします。
